Delhi HC debars Audi from selling TT branded accessories

The Delhi High Court has debarred Audi from selling TT branded accessories in India for the time being. The order comes after TT Industries, a Delhi-based garment company, filed a plea under the Trademarks Act, alleging that the German firm was violating its internationally known trademark.

The Delhi High Court issued an ex-parte interim injunction restraining the German automobile giant from selling accessories, bags, leather and faux leather goods and toy cars. TT Industries claims that its goodwill in the market is under threat and is seeking a permanent ban on Audi using the TT brand name in India. It has also sought Rs. 25 lakh in damages from Audi.

The plea claims that TT is a well-known global brand which has presence in 65 countries since 1964. The injunction plea has also said that the company had challenged the proposed trademark registration request that has been filed by the Audi group before the Trademarks Registry in India. The plea also challenges the trademark registration of the Audi TT coupe in India.

The court notice for trademark violation had been sent to the Audi offices in Germany as well as Mumbai. The company has been asked to file their reply to the plea by November.
