Mahindra-owned Peugeot Motorcycles Italia has been fined 1 million euros for a patent infringement.
In a statement released by the Piaggio Group, the company announced that the Corte di Cassazione, the Italian Supreme Court of Appeal, has rejected the appeal filed by Peugeot Motorcycles SAS and Peugeot Motorcycles Italia against the judgement of the Court of Appeal of Milan, which ruled that the Peugeot entities had infringed the Italian part of a European patent of Piaggio & CSpA.
The patent in question is related to the control system used in three-wheeled vehicles like the Piaggio MP3 to tilt sideways like a conventional motorcycle.
The Supreme Court upheld the judgement of the Court of Appeal of Milan, which also prohibits the import, export, marketing and advertising (including on the internet) of the Peugeot Metropolis. The court also stated that Piaggio & CSpA had the right to receive damages, which is estimated to be more than 1 million euros.
