Skoda Auto India has pulled off the Rapid Monte Carlo from its website and halted the sales of the said model after a court ruled against the carmaker in a trademark infringement case.
The company has been restrained from using the "Monte Carlo" name after clothing and apparel brand Monte Carlo Fashions alleged infringement of its trademark under the Trade Marks Act, 1999.
The additional district judge ruled that the carmaker had committed an infringement by using a trademarked name for a variant. The judge noted that Monte Carlo Fashions had a prima facie case on merit and has passed a temporary injunction restraining Skoda India from advertising, manufacturing and selling any goods with the "Monte Carlo" name.
