Was the co-passenger wearing a seat belt? Such a small gap can result in dismissal of the case as well. Follow such tactics usually used by the insurance companies to beat the case down if you can.

Chevyman, as you say the person who died was a Govt official on duty doesn't that mean a person from his family would be employed in his place or would be given job as per the education.

If yes then you have a chance to fight it on through this angle

My bike insurance expired last week. I was negligent as I am not supposed to ride my bike. Healing from a fracture. Today morning I almost decided to take my bike out.
Then I remembered this thread.

I skipped riding to work and instead got the insurance renewed as soon as I came to office and got online.

I pray from my heart that your father is cleared and all these troubles get over.
