Its a tragedy. Even worse is the way the police has treated this case.

The truck driver has been detained and a case under sections 304 (A) (causing death by negligence) and 279 (rash driving) of the Indian Penal Code has been registered against him. We have seized the truck and are investigating the cause of her death
Seriously!!! Inspite of this.

The only reason why i have a DVR is for "the just in case I am booked incorrectly for" something that i had no chance to avoid.

It's really unfortunate that an experienced rider & a mother to a young child lost her life in such a manner. May her family get all the strength to overcome this difficult time.

Sometimes it's difficult to understand if we are more sad or more furious due to the sorry state of affairs in our country.

Even I was contemplating a DVR, however now I'm sure it is imperative that we have one.

Not being insensitive here, but this is the same old story. When will we get to read something sensible? :Frustrati

Can a case of Culpable Homicide not amounting to murder be filed against the contractor or the civic body involved?

If I'm not mistaken, she was on a cruiser bike (Enfield), and having had limited experience with a cruiser - Bajaj Avenger I can say that these bikes react very differently to normal short wheelbase bikes. Something like a Pulsar or a Honda bike are very snappy and turn-happy.. not to mention that you can easily control them by throwing your lower body weight and snap them back into straight after a wobbling experience like out of a turn or a pothole. Cruiser bikes are much more heavier, built for slow and steady cruising and when you throw your body weight to alter its stance there's a great chance that the whole bike can topple. VERY dangerous, if you buy a Bullet or Avenger, treat them like they are meant to be treated, as a cool, straight-moving cruiser with slow, predictable lane changes and turns.. the elegance is in going slow on such vehicles. One should also be careful of wet roads/puddles when on any bike.. this ain't a car and the risk of slippage will always be there no matter the width of tyres or presence of "ABS".

"Why should I stop riding a bike? It's my passion. I feel independent when I am riding... I feel like I am flying. I come from a conservative family; they keep saying 'don't ride a bike, you will fall and break your hands and legs; nobody will marry you'. But I want to do more with my life, something different... I want to live my life to the fullest." This is what Hogale had said in a promotional video of her biking club Bikerni a year ago.
Before I get hammered by the "aurat kuch bhi kar sakti hai" brigade, I want to clarify that anyone (irrespective of gender) has the right to ride a bike, drive a car or do any such thing that makes them happy.. most of us want to drive or ride because it makes us feel lighter, makes us live in the moment and makes us happy. However its very unfortunate that in this case, this happened.. I never comment on threads about such incidents because I know how hard it is for those affected and how easy it is for strangers to comment, with greatest respect to this rider I only wish that she didn't do what she did on this particular ride, somethings seen in prospect are much more important than the bike.. like children and the love of family. Much strength to all involved.

Superintendent of Palghar police Manjunath Singh said, "The truck driver has been detained and a case under sections 304 (A) (causing death by negligence) and 279 (rash driving) of the Indian Penal Code has been registered against him. We have seized the truck and are investigating the cause of her death."
ANDD there we go!! The police flies off the handle based on public emotions and stereotypes.. I wasn't there at the scene and neither were any of the BHPians replying to this, but if the sequence of events were exactly as mentioned above, then the truck driver wasn't at fault at all. Imagine yourself driving at a height of 4-5 feet above the ground with nothing but blindspots around.. that's what I always imagine and I know that, this combined with a truckers propensity to move fast and change lanes fast, we must keep 2 vehicles length away from them at ALL times. Yes truckers are the worst type of drivers out there, 99% of them and I hate them, but if a vehicle slips suddenly in front of another.. who can be blamed? Hope truth prevails in the end.

Pathole said, "She was an experienced biker; she had been biking with us for the past three years. She lost her life due to the pothole."
According to Bikerni members, Hogale specialised in medium and long rides. She had covered Leh-Ladakh and even ridden on the world's highest motorable road on Khardung La in Ladakh.
Sometimes the common public roads, are the trickiest, most dangerous roads on earth. On hilly where there are rocks and rivulets and sand you know what to expect.. on plain tarmac its like playing Pacman. I never liked riding, and each time such news comes my hate for the 2 wheels gets renewed.

@dark

I would say, beep happens to even the safest of riders or walkers or even sleeping in the pavement(ers). Ask salman who knows its definitely not safe when he is playing real life carmegeddon.

Thats why i did not talk about the incident or how it could have prevented. Everyone rides our own luck and we are just lucky each day on road.

The sad part is the way the police happily booked the truck driver. Poor guy had the worst luck and he is alive to go through our police nonsense.

Hindsight is always 20/20 it is foresight that really counts . or something like that - read it somewhere on this very forum.

In our context.

two wheelers - inherently unstable, element of risk even at the best of times.
traffic discipline - chaotic , inherently missing
roads - inherently under construction - without adequate safeguards
roads in monsoon - inherently pot holed, water logged, messy, slippery, reduced visibility

Riding a two wheeler - driving it or riding pillion is probably the most risky thing that a common man/woman does on a daily basis. Some ride, out of sheer necessity, some for convenience and some for pure thrill. Few know the risks, many blissfully unaware.

Do take a look at the accident statistics below, two wheeler accidents probably account for the largest portion of the pie.

http://www.mapsofindia.com/my-india/...dents-in-india
http://pib.nic.in/newsite/PrintRelea...x?relid=146093

It appears to be a chronic ailment, superfluous solutions like wearing a helmet or protective gear seems to be a palliative.

Now compare this with yet another equally depressing statistic - Tobacco related cancers (TRC)

https://www.ncbi.nlm.nih.gov/pmc/articles/PMC5027787/
http://icmr.nic.in/icmrsql/archive/2016/9.pdf

Agreed that TRCs are 3 or 4 times more potent than two wheelers but look at difference in levels of sensitization of the underlying risk to the general masses.

Probably it is time that two wheelers also came with a warning sticker? I wonder if that would help.

Every time we get on a two wheeler we are knowingly putting our life and limb at risk. On any given day the roads, the traffic, the weather all do play a role but at the end of day it is our life and limb on the line.

At the end of the day , hindsight is always 20/20 . Question is - do we have the foresight to do something about it?

PS: All accidents are terrible, every precious life lost is sad.

As a driver, I consider potholes as things, like a lot of other stuff on the roads, to be missed or slowed down for. But I cannot say that I always succeed; I don't. Usually, on four wheels, the worst is an uncomfortable kerchunk and a cross word from the wife. Now I have to reflect that some of those failures-to-miss, on a bike, might cost me my life.

On the other hand, I sometimes observe others swerving around potholes right into my path. I can't say, but I feel that the pothole may offer less danger than a head-on collision.

Well said.

I do not tell anyone that they should not be riding a two-wheeler, although I do say that they should not be using as transport for their children. What you say is so true. Either through ignorance or through denial, they do not know. Just acknowledging what you said there would reduce 2-wheeler accidents substantially.

A minister now says that the person did not die due to the pothole!!!

"The road on which she was riding was water-logged and had become muddy and slippery. Her motorcycle slipped and she fell down. A truck which was behind hit her, killing her instantly. The accident did not take place due to potholes," he told reporters in the legislative complex.

What makes him say so when eyewitness has said that it was because of a pothole? According to the article she had enough time and kms of riding experience. I find it hard to believe she just slipped and fell because of rain even though she wasn't tackling some hectic corner or anything like that. Government ought to be ashamed.

A bone chilling accident. Fortuner and truck head-on collision near Jodhpur (Rajasthan). 4 persons died on spot.

I am posting only the pics of scraped vehicle rest pics are very disturbing so not posting here.

This is not new. In Bengaluru, they filed a negligence case against the husband when he met with accident resulting in the death of his wife.
http://bangaloremirror.indiatimes.co.../49018503.cms?

An Innova driven by a youngster from Coimbatore, who made a trip to
Malampuzha garden, was damaged after he crashed the vehicle into the Kanjikode/Malampuzha railway crossing in Palakkad. No one was injured. From what i understand he had taken the car for a spin with a girl and was driving at high speed on his return run.

Yet another inhuman case of a driver jilting his passengers when his van met with an accident. The passengers were school kids who were being ferried by an driver licensed to ride only two wheelers!:Frustrati

This happened in Vandalur, Chennai. One kid died and the others injured. Really gut wrenching to read this

"A team of the Otteri police which soon arrived at the spot later arrested Karthik and found he only held a licence to drive only motorcycles with gear (MCWG). Nithyanandam(Owner of the van) knew this and yet allowed Karthik to ply his van trasporting children to and from school, putting their lives at risk, police said."

The NH-24 isn't wide enough for vehicles to drive above 40kmph and this happens. Our NCR is seriously in shambles. http://www.financialexpress.com/indi...ors_picks=true
