In a safe scenario (you know the buyer or in good relations with the bank staff), this would be a great setup - the process is guaranteeing that the transfer is initiated.

But if not, this puts you at the risk of not receiving the full payment before the transfer of ownership.

- Are step 4 & 5 on official bank letterhead (basically is the bank guaranteeing the process will go ahead without fail)?
- Who guarantees the buyer will then do the remaining 50% payment to you (after the bank transfers the money to his account) and not bring up 'issues' to reduce the final payout?

Very risky approach - as a thumb-rule, expect the full payment before initiating the transfer of ownership (and asset handover). Keeping only a token amount (say 10%) can be considered in the above process but 50% is a no-no.

Re: ARTICLE: How to sell a *USED* car in India

Hey @GTO,
I am new to the "whole buying a car from another state" process and I really don't know what I should do to make sure that the car I am buying is free from any liabilities. Can you please guide me through this process??

This may take 4 weeks min considering the Covid situation.

In addition to the above, what else precautions do I need to take to ensure the transfer of liability to the buyer along with ownership & Insurance. The Buyer will need to pay the road tax to register the car in his name, so what if he delays it. The liability will still on me since the ownership transfer hasnt been completed.
Were you able to sell your car? I am in a similar situation and would be great if someone can help me understand the process better.
I am trying to sell my 2 cars (MH registered in Bangalore & KA registered in Mumbai). Former being an old Aveo for which I got the HP removed and NOC granted from Andheri RTO and did pay KA Road Tax for the car to be used in Blr. Now Cars24 is asking me to get a new RC issued from Andheri RTO as HP has been removed but RC still shows it. OLX auto wants me to cancel the Andheri RTO NOC before they can entertain to sell it to their channel partners in Blr.

1)This is quite confusing as I think that cancellation of NOC would mean the Karnataka Road Tax that was paid would be null and void? Also I would have to go with OLX irrespective what offer they give me.
2)How come cars24 and OLX Auto have totally opposite requirement?

Is there a way i can register the car locally in Blr and then sell it? Maybe that will ease out the things? I do nor reside in Blr anymore. Or maybe I get the car back to Mumbai and sell in Mumbai (of course NOC cancellation would be needed but that is logical).

Sorry for quoting the big post.

Very fortunately I was able to see the MH car to a MH guy only who came from Hyderabad but actually hailed from Kolhapur. So the RTO transfer with MH was much easier. I learnt it a hard way that selling a MH car in KA is a very painful process coz the moment you mention that buyer would need to pay road tax in KA, the buyer would back off or quote a horrifying price.

I think you should attempt to find a MH buyer for the MH car and same holds for KA car too.

Re: ARTICLE: How to sell a *USED* car in India

Hello learned BHPians,

There is a trouble for which I need advice and this forum seems the best place for the same. The post is a bit long, so is the issue, kindly hang on!

My father owned a Santro EuroII model in 2000. In 2015, as we were planning to buy a Chevvy Beat, my uncle requested that the older Santro be given to him and not sold away. The Santro was in top notch condition, racking less than 50k kms in its 15 years with us, so we agreed. The paperwork was drawn up, my father the seller, my uncle the buyer. All details were given to an agent to get the job done.

Being ignorant and generally easygoing about car things, neither party followed up much, and relied on the agent's updates. Turns out the agent failed to transfer the car in the jurisdiction he was supposed to. Most of the RTOs rejected the application, since the car was more than 15 years old. He managed to get it into the system for transfer in Darjeeling RTO, which has no bearing at all, except being in the same state as where the transfer was to happen. And there, it got stuck.

NOC is approved from the originating RTO, but it is stuck at the Darjeeling RTO since last few years.

In the meantime, my uncle has been using the car for local trips and all. Him being a lawyer, and the car being plastered with "Lawyer" stickers helps him get by, despite the car having Bihar registration in West Bengal.

The car is now 22 years old, and sadly, still runs fine.
My fear is that in a situation, where the car runs into some issue, whatever that may be, it will be my father on the line first, since the car is still technically in his name.

Checking up the RTO records, show that the registration was valid till March 2020, same for the tax.

I know, my father should have taken care about this, and taken the due precautions, etc etc, but he hasn't and I cannot change the fact. What is the step forward? How do I indemnify my father from this situation? Any advice on this matter would be immensely helpful.

Re: ARTICLE: How to sell a *USED* car in India

Hello folks,
When we sell our car/motorcycle to a user car dealer he will only give us a delivery note and take our signatures for 29/30 etc. In this case, what do we inform to the RTO? Can we send registered post with details of the dealer only?
Any advice would be greatly appreciated. I plan to trade in my car while buying my next vehicle.

Buyer from far away place can be an issue. Otherwise, you could both visit RTO together, submit transfer application, get acknowledgement receipt and then only handover car key.

I'm getting my own agent to get the clearance certificate from my home RTO in Bengaluru. Does that ensure fool proof in any way ?

Make sure

1. You have not given the fellow blank transfer papers
2. You have collected his ID proof (Aadhaar) and PAN copy.
3. Send all these along with a copy of the sale paperwork to the RTO along with Form TCR https://www.scribd.com/document/3199...O-Form-TCR-pdf
4. Send all these to your insurer informing them that you have sold the car

When you send these by post send them registered post or speedpost ACKNOWLEDGEMENT DUE, and make sure you keep a copy of the acknowledgement along with a copy of the form TCR / sale paperwork in a file.

In both cases RTO and Insurer - you have notified them that the car is sold, so that you have no liability

Try not to sell to out of town buyers anyway 99.999% of the cases they're dealers.

Re: ARTICLE: How to sell a *USED* car in India

I have (painfully) decided to sell my Polo GT, it is in absolute mint condition, only 19k km done. Have put it up in the TBHP Classifieds and expecting it to sell pretty quickly.

A question regarding the transfer of ownership (private sale):

If I do the whole procedure online on the Vahan website, there is still a requirement to visit the RTO to submit the docs. In this case, is it legally/ethically OK for me to hold on to the 2nd key till the transfer is done? This is only to ensure that the transfer does get completed ASAP and the new buyer will do it. Don't want to be running around after him to get it done.

Thanks for your help.

Re: ARTICLE: How to sell a *USED* car in India

What am I supposed to do in a situation like this: I sold my Ford Ecosport D-Tit to OLX in New Town, Kolkata on 02/04/22. On 31st May they asked me to travel to Murshidabad RTO to process the transfer. The vehicle was purchased and registered at RTO Beltola/Kolkata. I'm 70 and unable to travel so far. Any suggestions?

Re: ARTICLE: How to sell a *USED* car in India

I just got an XUV300 and sold my 2011 Hyundai i10 1.2 Sportz with 23000 kms.

Good - Single owner, bonnet/roof/trunk original, well maintained, like new interior
bad - all 4 tyres old, 4 doors and bumper repainted

Final sale price (Bhubaneswar, Odisha) - 1,77,000

My process:

Preparation: I spent approx 17k on repairs to get the car look better
body had lot of visible scratches (multiple drivers) - spent approx 14k for repainting. Selected the shop from google and it was a good experience (Avoided shops that magically got multiple 5 stars in the same month).
Car AC gas refill - 1300
oil change and check for major things - 1500

Sale:
1. Requested Cars24 : quote came at 1,47,000
hassle free process for getting quote.
I later noticed in the inspection report that came through SMS that the guy who came for inspection marked RC, duplicate key as not available. As well as Chassis number as untraceable. Those 3 probably impacted the value.

2. OLX - checked the price at which similar cars were listed. most were in the 2L zone with some at 1.9L.
posted on OLX at 1.9L, and in the calls agreed to sell at 180k. On further negotiation, added a 3k if transfer done immediately.
I could immediately see that 180k was a really good price for buyers. Especially since the car engine was good, and with the repaint, it looked good too. Got 2 serious offers within a day.

Overall advice:
1. Use cars24 to get base idea, but make sure the inspection guy didn't make mistakes in the report.
2. Use OLX, if you have 2 days, and the ability to either take about 1 call an hour (plus 10 minutes per hour to monitor queries in OLX chat), or have someone who can help with either of those
3. Make sure the exterior of car looks really nice as compared to other posts for similar make/model on OLX (20 mins research is a must do to find out where your car stands in terms of attractiveness to a buyer and price accordingly)
4. If you are in a hurry, price 20k below the average on OLX. If you have weeks of time on hand (or another friend/family who has free time), you can probably price 10k more.

Re: ARTICLE: How to sell a *USED* car in India

I have decided to part ways with my Elite i20 (2018 model). The reason being very low usage - 11K in four years. Car was serviced only at ASS and barring a couple of small mishaps where front bumper was changed, the car is in perfect condition.

Talked to Hyundai dealer last week and they are quoting 6 lakhs for the car. I was told I will be paid in 5-7 working days and the car will be registered in Hyundai's name.

I did not even talk to Cars24, Spinny etc as I read many posts mentioning non transfer of ownership even after many months/years.

Any suggestions, BHPians would like to provide selling my car to the dealer?

Spinny is professional about a sale and does transfer the RC once sold. But the car may lie in their inventory for a few months before being sold.

You need to periodically check if they still list your car for sale and can then after a few days download the updated RC in the parivahan app.

I sold my last car (scorpio) through Spinny. I also made the mistake of approaching cars24 for a quote where they first gave an ultra low quote and then continue to call me almost a year after the car was sold asking if I have a car for sale. Cars24 are the worst kind of spammers.
