Now I would like to seek advise as to how should I proceed to absolve my liability as the point of getting the car blacklisted continues to remain a grey area w.r.t to the liability portion and also if it is possible to get it done in the absence of a delivery note and how to go about it, i.e. via approaching the concerned RTO directly or filing a FIR or some alternative measure.

Cheers!
Usually the buyers delay the transfer because it is a chore and they may be lazy.

If that is the case here, the best way is the have the transfer done yourself at your cost.

Get the documents from the buyer and find a reliable agent and have the transfer done.

Just think of the added cost as the price to pay for this mistake.

We had sold our old car a while back and don’t have the delivery note too now. On a recent check I noticed that the new buyer has not initiated the transfer and on every reminder he’s been cooking up one excuse or the other and the same has been going on for more than a couple of months now.

The most ideal solution is to lodge an FIR in your local police station and send a copy of the same to the new buyer via registered post. Thereafter the liability rests with the new owner. However in the absence of any delivery note, this might be tricky. So you may show details of payments received through bank statements.

Hi, sorry missed your post was busy with end sem exams around that time.

So in my case we kept following up with the other guy diligently and, politely(or not so politely) gave him a date post which we will proceed with blacklisting the Car. Luckily that got him moving.

Rest everyone has already chipped in with their advises

You can reach out to the RTO head (where your Car is registered) and they would guide you on the same. Had read the same on one of the threads here only on TeamBHP but can't recollect which one.

The point however I'm not sure about is whether the liability gets extinguished from us as the same is unanswered and continues to remain a grey area.

Maybe start by having a word at the RTO and then decide your further course of action.

Re: Old car sold, new owner refusing to transfer ownership

Last week I sold my 13.5 years old Wagon R Vxi in Delhi.
Had got it evaluated by Cars24, Spinny and a few used car dealers a couple of months back, but at that time I was not really ready to part with the vehicle as I had not done my research on which new car to buy.
The highest offer was from Spinny. Approximately Rs 1.40-1.45L (as far as I recall).
Some dealers said, leave the car and they will find a buyer.
Some dealers agreed to pay me upfront and take the car for further selling. Price offered was somewhere between 1.0L to 1.20L.
Also got it evaluated at several Maruti Tue Value. All of them quoted surprisingly low values (as low as half of Spinny).
In all these cases, I was apprehensive of the RC transfer after handing over the car. With True Value, I had the confidence that they might not take me for a ride, but the value offered was too low.

So, what did I do:
Since mine was a low value utility car, and almost at end of life in Delhi NCR, I was aware that the best buyer could be a potential taxi driver who would re-register it in some neighboring state, or someone who would buy the car for personal use in some small town.
I spread the word among drivers and car cleaners in my neighborhood.
I quoted Rs 1.40L and as soon as bargaining started, I dropped it (to the surprise of the potential buyer) to 1.30L at one go. This was my strategy as I was willing to accept a price between 1.25 and 1.30L.
However, my condition for dropping the price was as follows:
Pay the full amount, take the RC and my signatures on Form 29 and 30. Get the vehicle RC transferred. Once I see the RC transferred to the new name, you can take the car. This was possible because there was an intermediary (driver of a nearby house who brokered the deal).
He vouched that he knows me and the car would be safe in the colony.
My strategy worked. The buyer hired an agent who promised to do the RC transfer within 48 hours (Delhi has the online system).
Upon further negotiation, I agreed to bear half the cost of the RTO agent who was charging Rs 4000 for tatkal transfer.
Received Rs 1.28L and signed the papers and handed over the RC. The buyer did not even insist to keep the keys with him.
Handed over the car the next day evening after getting screenshot as proof of RC transfer from the agent.
I agree, such an ideal scenario might not be possible for everyone. I was just lucky that my plan worked.

Did the new owner's name reflect in the Parivahan Portal within 48 hours?

Day 1: I (seller) and buyer signed Form 29 and 30
Day1: Before evening, the agent uploaded Form 29 and 30 pdf.
Day1: Same time I get OTP on my Aadhaar verified mobile which I share with the agent.
Day2: Before noon the agent shared screenshot of RC transfer. I logged in Parivahan site to double check. It was showing the new owner name.

RC smart card will be received by the buyer in a few days time. He will the share a copy with me on Whatsapp.

Actually, I too ad never expected that RC transfer could happen so fast.
The agent was paid Rs 4,000 for the job.

This is amazing! In my situation, it took around 10 days for the new owner's name to be updated in Karnataka. Typically, the update would happen within a week, but it took longer in my case because they mentioned that no updates would be made in the last week of March.

This is a good process for everyone to follow. It's better to be safe than sorry. Only after the new owner's name is reflected in the Parivahan portal should one hand over the keys.
