Mahindra has filed its trademark for "BE 6e" under Class 12 of the Trademark laws, specific to vehicles, whereas IndiGo’s registrations are under Classes 9, 16, 35, and 39, which cover transport services and advertising.

Trademark protection is inherently class-specific. IndiGo’s trademark is in aviation and related services, while Mahindra’s pertains to vehicles. For a court to rule in IndiGo’s favour, it must demonstrate that its brand recognition extends beyond aviation.

Not sure why Mahindra need to name a car like a spare part of a machine or why Indigo need to get so lathered up over it. Only reason for Indigo could be to deter others in the future or we might soon have clothes detergent named 'Whiter with 6E' etc.The old fashion brand Indigo Nation is upset too! Maybe IIT Bombay's kids should stand up for Mood Indigo.

Indigo can't win this in a court of law.

Trust me I am no friend of Rahul Bhatia but I do believe this so called survey is a piece of dubious commercial horse manure being quoted endlessly by media who don't read, don't do any home work and don't understand. Ha, that's not how it works. If Mahindra named one of its cars 'Indigo' then the airline wouldn't be able to do anything about it. There's no case. 6E, on the other hand, becomes an identifier for the airline since it's quite specific to Indigo airlines. It's also why Mahindra wouldn't be able to do anything if there was, say, a Scorpio airlines launched tomorrow.

What I find really amusing is that a tacky, sexist piece of nomenclature imo (it was supposed to mimic 'sexy') which was then used to define how the airline was 'cool' (they ran a campaign 'sleep with your wife' to show they were doing red-eye flights back to the city of origin the same day) is now a bone of contention.

But then knowing how 'Monte Carlo' the clothing brand sued Skoda, and how Barbara Taylor Bradford lost a copyright case against Sahara TV in India for plagiarising her novel, any publicity is good publicity. We really are the wild wild east

The new range of electric cars i.e. BE 6e & XEV 9e from mahindra look amazing, are feature rich and appear to be competent cars, however i find the names of these cars are a bit odd. In general also, i find the name of mahindra cars a bit odd like the XUV 700, 3XO, XUV 400. As rightly said, these names sound like part numbers.

Though it is also correct that for the word 6e, both indigo & mahindra have got the trademark for different classes. However the word/expression '6e' has become an integral part of the indigo brand name and their user of the said word is much prior to that of mahindra and hence mahindra would not be able to successfully contest it in the Court and should rather come up with better names for their electric range of cars.

This somewhat reminds me of when Ferrari wanted to name their F1 car the F150 and Ford objected to it by saying people might confuse it with the Ford F150. XD

“We believe our mark differs fundamentally from IndiGo’s ‘6E,’ which represents an airline, eliminating any risk of confusion. Moreover, our registration application is specific to a different industry sector and product,” Mahindra said in its statement.

Mahindra also pointed out that IndiGo had previously faced a similar challenge from Tata Motors over the “IndiGo” name, as Tata had used the Indigo brand for its cars. Despite Tata’s objection, IndiGo retained its brand name, arguing it operated in a different sector. Mahindra finds IndiGo’s current stance inconsistent with its earlier actions.

“We find it unseemly that two large Indian companies are entangled in a distracting conflict when we should be championing each other’s growth and innovation,” Mahindra noted in its statement.

That means that the Patent stays and the case continues till the final outcome is declared. I wonder what is the status of Tata Motors vs Interglobe Aviation in the Indigo trademark case? No updates since 2015.

I'm on Mahindra's side here. No matter the deign, nobody is going to get the 6E confused with a plane. And I have not seen a single person refer to IndiGo (or other flights for that matter) by their IATA callsign. Quite frankly, IndiGo should not even exist, if the Tata Indigo came years prior, and by IndiGo's logic, neither should OpenAI (the makers of ChatGPT), considering that Air India came years prior.

Doesn't Mahindra have a strong Legal and compliance team to check all these implications before going all over the place with such a codeword name? Why are they talking about a legal battle after the release is over?
