Will be paying tax next year, as the car will complete the first year next month. Will weigh in the options to pay in MH or KA based on convenience. Technically, we can just keep paying to MH and it should be fine.
If the KA authorities don’t take in the tax, there’s always the option to pay in other state (MH in our case). |
Law says that the change in the state must be informed to the registering authority within 30 days, if relocating. But again it is hard for cops to verify the number of days and whether a person is relocating or not.
Any news or pointers for BH registration at Telangana? Is there any contact who can provide correct information if private employees (having offices in Telangana and other 4 states) can get a BH number ? Who ever we ask i.e. agents and dealers, all are stating not started.
This is really sad. The states that are reluctant should understand that they will not only loose on the tax but also on sale of new vehicle. My friend just purchased his new car from his hometown in UP just because the dealers in Karnataka are not taking up the BH number requests.
This is just an unfortunate case of a slow moving and rigid bureaucracy.
Adding to the above, my friend dropped his car purchasing from Telangana as BH registration was not assured. He purchased from his home state WB and got BH registration done. He is a Private company service holder which has presence in 4 states in India but not in WB.
Any recent experiences of private sector employees who got their cars with BH registration in Bangalore/Karnataka ?
Dealer is saying that BH registration for private sector employees is currently not allowed in Bangalore.

Update on BH Series WP.
The matter was listed today before the Chief Justice. (Court Hall No.1)
The arguments have been completed and the matter is reserved for judgement. Interim relief was not granted to the state government as they had applied for stay.
I will update you as an when the matter is posted for Judgement.
Fingers crossed.

I see that the karnatakajudiciary.kar.nic.in web portal is still showing as "heard, judgement reserved". The KA high court was out on summer vacation till 20th May (to the best of my knowledge). The judgement should be released some time soon (hopefully).

Yes, going for a new Venue and was interested in checking BH number. But the dealer said the same.
Understand from messages above that the judgement is still not final / implementable. It's really sad !

Is there an update on the judgement related to BH series registration in Karnataka? None of the dealers seem to be taking any application in this regard for the private sector employees....pls update if anyone has any information on this topic.

No updates as of yet.
The Writ Appeal is yet to be listed before the High Court of Karnataka for pronouncement of Judgment. Have it on very good authority that - as the State Government has changed in the intervening period, that even if the State Government were to lose the appeal, they / the Transport Department would be filing an appeal before the Supreme Court.
However, all of this is academic. As of now, there is no stay on the operation of the Order of the Single Judge who in his judgment had directed the State Government to implement the Central MV Act (20th Amendment) Rules, 2021 issued vide notification bearing No.G.S.R.594(E), dated 26.8.2021.
The citizens of the State are well within their rights to initiate contempt proceedings against the State for failure to implement the Judgment passed by the Court. In my personal view, this too is unlikely to make a difference, as the Court may take a view that since the Division Bench of the High Court is yet to pass its judgment in the Appeal filed, it may refuse to initiate contempt proceedings against the State for failing to implement the Judgment of the Single Judge. If at all some people were to initiate contempt action, there may be some pressure to direct the State RTO authorities to commence registrations of private employees under BH registration.
Otherwise, the appeal proceedings (including proceedings before the Supreme Court) will continue for another 3 - 4 years (minimum) before any resolution is finally arrived at.
This is the grim reality of the situation.

Congratulations private sector employees of Karnataka.
Thanks Silwerwood for spearheading the case :thumbs up
Though it is sad that for a just and fair cause, the citizens are forced to fight legally the state, it is a sweet victory clap:
Does that mean they should start BH registrations soon, or just that the legal battle now goes to next level?

Congratulations, SILVERWOOD! It requires a lot of patience, courage, and effort to fight against all the evil forces that play spoilsport in the pursuit of justice.
To other lawyers in the forum: Can this judgement be taken as reference in other states which refuse to implement BH series?

With a ruling party differing in view with the centre, i guess the following is going to happen in Karnataka.
1) A new legal appeal on BH to the SC.
2) Once they lose the battle in SC, catch hold of "RTO Software" as an excuse to not implement BH to delay it as much as possible.
2) Ktk Govt already has declared no development for the state till this year end (courtesy freebie politics) and for all this and to recover the upcoming loss due to BH will start taxing the EV vehicles during registration, which till now was exempted.
