• He said that the documents a Non-KA Vehicle owner need to carry apart from the mandatory 4 documents (DL-RC-Emission Certificate & Insurance) are
Toll Bills
PUC from other state
Wheel Alignment-Service history-etc
Aadhar card etc.
Fuel bills.......
• He said that if anyone is harassed in spite of having any of these documents, one should immediately contact the Transport Commissioner on 98451-99170 and should also immediately email their grievances on transcom@nic.in or Mr.Muniveere Gowda (Asst Commissioner) at 9449863214.

4-Sep-2014, Thursday, 10am'ish, Forum Mall, Madiwala

TBhpian's car stopped by a LARGE TEAM; 50 odd "volunteers" of KA RTO

Car/owner is a Hosur Resident and no amount of talking could make sense to the RTO guys on the scene. Finally handed over "Original DL" and drove on with the car.

Owner returned after few hours after collecting a bunch of documents from Hosur to prove Hosur-Residenship and after a long & "Cordial" Meeting with Kormangala RTO (a young officer) GOT BACK the DL (no tax or fine needed). He was a sensible person and very gentlemanly who could emphatize with the situation but clearly mentioned that it was not in his hands and orders from up above is very clear and curt - "Daily Targets, # of cars Seized, Amount of Revenue collected" to be submitted up above. Post the meeting, he was kind enough to hand his VISITING CARD and call in case of future incidents like this.

Highlights (Especially for Hosur Residents)

1) This car had 'electronic' toll pass for both Attibele and ECity BETL. Thus a important visible paper document showing same-day entry was missing.

2) Strong advice from Kormangala RTO chief to carry all-possible Hosur address proof (DL, Aadhar, Passport copy, Telephone bills, similar) always in car and imperetive to have toll-receipt in PAPER with FULL CAR NUMBER.

3) Even last oil-change bills from hosur service centers, wheel alignment bills, and PUC certificate welcomed by the RTO Chief.

4) This car had made a error by getting the recent valid PUC from Bangalore (daily commuter, so just drove into a nearby bunk in blore and got the PUC done there) - that turned out to be a bad decision!!

5) Previous page flip-flop information provided by me was indeed/originally true - ECity (next to Dmart) BETL office DID INDEED give a DOWNLOAD of last 30 DAYS of Electronic Toll payments made by the windshield mount E-Pass. BUT it is a MONUMENTAL pain to convince them to give it, and their computer-server speed is better NOT spoken of here - took a good 2 hours to get incomplete data. Recent 2 weeks data not found!!

Hosur car owners - Last but not least - Even if car/Document impounded, PLEASE dont make a scene/ruckus before a Government Officer of Any state - present yourself to the correct authorities and state your case and as we have seen in 2 cases here, You will be heard!

Rule 46(3) of the Karnataka MV Rules requires details of any non-KA registered vehicle to be intimated to the local (KA) RTO within seven days of entry into the state. This seems to be in addition to the >30-day registration requirement reported by OP. Please keep this in mind if ever police / RTO conduct a check.

Reproducing the section:

(3) Where a owner of a motor vehicle who had registered his vehicle outside the State, has brought his vehicle into the State or is for the time being kept in the State shall intimate to the registering authority in whose jurisdiction such vehicle is kept for use in Form KMV 27 within seven days from the date of entry of the motor vehicle in the state

Sachin updates us as follows

Updates on the Karnataka RTO operation against non-state vehicles.

Kerala State Government and Chief Minister takes the initiative to talk to the Karnataka counter parts. The Transport Secretaries for both states discussed the issue. As per news reports Karnataka RTO would now "go slow" on tax collection from Kerala registered vehicles. But the Karnataka government clearly stated that the laws in the state has changed, and it would remain valid.

Karnataka RTO plans to go-slow till more clarity comes on the new central Road Transport Safety Bill is put up in Parliament and passed as an Act. There is no clarity on what Karnataka RTO plans with vehicles NOT from Kerala state.

The Honorable Supreme Court has disposed our Petition with observations and liberty that the petitioners should approach the High court and challenge the MV Ammendment under article 226 of Indian Constitution.
Please note that our petition will never be dismissed in high court as we have ruling to this effect from Honorable Supreme Court.
We will file the Petition in Hight Court early next week.

The above link is of Mathrubhumi a Malayalam News paper. The news is in Malayalam. Interesting points:-
1. Kerala minister says that Karnataka Minister has "assured" him that Kerala vehicles would not be seized by Karnataka RTO. He feels if any Kerala vehicles still getting caught, it is mainly due to Karnataka RTO officials trying to harass the owner/driver.

2. The new Road Transport Bill would be tabled in Parliament during the winter session, happening in another two months time. Once that becomes the new law, there would be more simpler procedure for tax collection and sharing of the tax between states.

3. Kerala Minister says that Karnataka CANNOT modify the new state specific law to specifically exclude vehicles from Kerala. There are some legal challenges in doing that.

Point #3 takes the cake . So all assurances from Karnataka are just in words. Naturally the state cannot have a very discriminating clause which says that Kerala vehicles would be exempted. The vehicle owners from other states would cry foul. But I do appreciate that the Kerala Govt. at least took this up with Karnataka. Many other states have not done any thing of this sort.
